SCA rejects OUTA’s submissions for condonation of the late review in E-Tolling case

In the so-called “e-tolling” case of Opposition to Urban Tolling Alliance v The South African National Roads Agency Limited (90/2013) [2013] ZASCA 148 (9 October 2013), the SCA today handed down judgment dismissing the appeal and rejecting the appellants arguments as to why the time limit for making the review application should be extended. The SCA refused to condone the delay in the appellant’s review application on the ground that preventing tolling would cause severe prejudice to the respondent and the public as a whole. In the result, the court held that it was prevented by the provisions of s 7(1) of PAJA to embark upon the merits of the review application.
