SCA holds that South African authorities must investigate crimes against humanity committed extraterritorially

In the landmark case of National Commissioner of the South African Police Service v Southern African Human Rights Litigation Centre (485/2012) [2013] ZASCA 168 (27 November 2013), the SCA considered the issue, arising directly for the first time before the Court, whether it is competent for South African authorities to investigate crimes against humanity committed extraterritorially. The SCA held that SA authorities do indeed have a duty to investigate allegations of torture in neighbouring Zimbabwe under the Rome Statute of the International Criminal Court.
