The final say on business interruption insurance and Covid-19

I’ve been following the media reports relating to the Café Chameleon case and their claim that their business interruption insurance... covers losses suffered due to Covid-19. The last I heard was that this case was being appealed by the insurer. I have a similar argument going with my insurers, and would like to know whether there is any finality yet on the matter.

Who NOT to keep secrets from? Your insurer.

Recently I was confronted with a matter where a client failed to disclose information on her insurance application form, which... led to a claim being repudiated.Luckily, there are procedures to be followed in order to determine whether or not the repudiation is valid. The important aspect that needs to be considered in determining if the repudiation is valid, is whether or not the non-disclosure comes down to material information that was omitted. On this point our case law has been settled that the insurance has the burden of proof to show that the non-disclosure was material of sort and the repudiation was valid. Even though you have remedies and appeal procedures to be followed, you would rather not want to be embroiled in a dispute which could have been avoided. The rule of thumb when dealing with any insurance, is to fully disclose all the information that you have available, even if you may think that it is not relevant or not important at all. Therefore, rather take sufficient time to thoroughly complete the required forms ensuring that you do not face a situation where a claim is repudiated. In some instances you may even be assisted by your broker while completing the forms. If this is the situation keep in mind that it remains your responsibility to ensure that all the information is provided.Should you have a claim that was repudiated, do not hesitate to contact me to assist with further representations.

Do I have to tell my insurer about my lapa?

I recently added a thatched lapa to my house. I have an open braai under the lapa. With the recent... bad winds some coals were blown into the thatch and started a fire. I lost the whole lapa and part of my house due to the fire. I lodged a claim correctly with my insurer who has now informed me that they are repudiating my claim because I never informed them of the lapa addition to my house. Can they do this?

Don’t let a lack of railings on your stairway be your downfall

A plumber visited my new house to repair a water leak in my upstairs bathroom. He fell from the second... story of my house and claims that he fell because I did not have stair railings. I have not yet had my railings installed as they are quite expensive and I am still saving for this. We have however been using the house for a few months without the railings and without incident. The plumber is now threatening to sue me for damages. Can he do this?

Road Accident Fund claims: Must I pay back my medical scheme?

On advice of your... attorney you also submitted a claim to the Road Accident Fund for your medical expenses.
