Hybrid work arrangements are great, but is your business information safe?

Your business was forced to enable staff to work remotely during lockdown. Surprisingly, it worked so well for both staff... and your business that you have continued with a hybrid working environment with staff working from home and the office on a rotational basis. Productivity has not been affected and staff appreciate the flexibility that the hybrid work arrangement provides. A nagging issue though is the question of whether your business information is as secure with staff at home as it is in your secure office environment?

To post or not to post? When is privacy violated?

Your neighbour has been piling heaps of rubbish on his sidewalk. You’ve raised the issue with him but to no... avail. Now you’ve taken photos of the mess and want to post them on Facebook to try and get other neighbours to also put pressure on him to clean up the mess. However, you pause and wonder about whether you can post the photos and identify your neighbour. Is it an invasion of privacy, or in the public interest?

May I refuse access to my property for electrical meter readings?

I am currently an owner of a residential property and I sometimes get visits from employees of our local electricity... provider requesting access to the property to take a reading of the electricity meter. This is often an inconvenience to me. May I refuse them access to my property?

CCTV cameras in the workplace? Allowed or not?

We have had a spate of thefts in our business over the last few months. Yet none of our employees... ever see anything or know anything, which have us thinking that the thefts may be wider than just one or two employees. We are considering installing CCTV cameras to monitor the situation and also prevent further thefts, but are unsure about the rules for monitoring employees with CCTV cameras and also using such footage should we pick up misconduct. Can you maybe advise on how we should go about this?

Disclosure of medical records vs the right to privacy

A client recently fell over boxes standing in the aisle in my store. He is suing me for damages claiming... that the head injuries he sustained from the fall resulted in him being fired from work. I’ve heard from another source that he was dismissed because of a history of alcohol and drug abuse and that he has been in and out of rehabilitation. We’ve requested access to his medical and psychological reports, but his attorney refuses claiming medical privilege. Surely, this cannot be right, particularly if these can prove that there were other factors leading to his dismissal?

5 reasons why POPIA is not a curse word

POPIA has for years, and especially since coming into effect on 01 July 2020, attracted significant attention. While this legislation... does of course place new compliance obligations on businesses during a time of economic difficulty and uncertainty left in the wake of the COVID-19 pandemic, it is certainly not bad news, whether seen from a business or personal perspective. Here are five reasons why the coming into effect of POPIA is actually a really good thing:1. The flow of personal information is now better regulated – POPIA imposes new rules and accountability for how personal information may be used and shared.2. Data Security – POPIA requires that any entity in the possession of your personal information must take active measures to ensure that they keep your information safe and secure.3. Access to information – Any entity that is in possession of your personal information must at your request, provide confirmation that they do have such information and provide you with access to that information.4. Notification -  POPIA requires that if a business has experienced a data breach during which your personal information has been compromised or leaked they must inform you of any such breach and any measures they have taken in order to remedy the breach.5. Quality marketing – POPIA has changed the rules regarding electronic direct marketing and essentially requires businesses, of which you are not an existing client or customer, to obtain your consent before they can market their goods and services to you.Hence, five solid reasons not to view POPIA as a curse word - but rather as legislation that does in fact, make our world a better place.

Can your ex-spouse circulate your private information?

My ex-husband still has access to our shared cloud account. Unbeknown to me this meant he could see all my... back-ups of messages, photos and other personal information. Our divorce did not end well and he is now sharing private and personal information of me with third parties to embarrass me and to try and portray me as a bad parent. What can I do to stop him?

I’m the owner of a small advisory firm. A few days ago, one of my employees left his laptop in... the car during the weekend and it was stolen out of his car. I now hear that the IT guys forgot to have encryption activated on his laptop. With client information on the laptop I’m worried about whether I could be in breach of POPIA. Am I?
