When floods damage property, who is liable? Owner or tenant?

With large parts of the country having recently been flooded due to heavy rainfall, many people have suffered damage to... their property.Naturally, when rental property gets damaged due to rain or floods, the question then comes up of who will have to pay for the repairs? The tenant or the owner?The general rule is that the risk and liability involved with immovable property will always be that of the owner.This means that the owner of the property will be responsible to repair damage to the structure or permanent fittings to the property. The owner will have to repair any damage caused by acts of nature, which is outside of human control, such as floods, violent storms, earthquakes and other natural disasters.The tenant will only be liable for damage caused to the property by his or her negligence. For example, if the tenant negligently causes a fire in the kitchen and burns the property down, the tenant will be liable for the damage caused to the property.With property in a sectional title scheme, the position is regulated by the Sectional Title Act. In terms of section 37 of the Act, the body corporate is responsible to repair damage to the common property. The roofs, outside walls and foundations all fall under the common property and therefore if there is water damage due to rain or floods, the body corporate will have to pay for the repairs. To summarise the position, the person who caused damage to immovable property will be liable to pay for the repairs. In the case where the damage caused is no one’s fault, such as in the case of floods or natural disasters, the owner of the property will be liable for the repairs.

When is a landowner responsible for a fire that spread beyond his property?

I own a small holding of a few hectares. Recently, with the heavy winds in the region a veld fire... started on my property. I’m still not sure what happened, but the fire spread quickly, despite my attempts to stop it, to my neighbour’s property and caused damage to some of his sheds before we could get it under control. Needless to say, my neighbour is very upset about the damage and I think is contemplating holding me responsible. Can he hold me liable for the damage?

Capital gains tax paid on monies not received? What can you do?

I have a few investment properties in my property company. One such property I purchased in 2002 for R200,000 and... subsequently sold in 2013 for R3,500,000. My company paid income tax on the capital gain as though I received the full R3,500,000. However by 2016 I had only received R1,500,000 when the other party fell bankrupt, leaving me without the full purchase price. SARS refuses to pay back the amount I overpaid, and I now have a huge capital loss in the company. Is there anything I can do?

The school denies any negligence and feels that my son should have kept a sharper eye on possible dangers. Is the school liable, or is my son alone responsible for his damage and injuries?

Don’t let a lack of railings on your stairway be your downfall

A plumber visited my new house to repair a water leak in my upstairs bathroom. He fell from the second... story of my house and claims that he fell because I did not have stair railings. I have not yet had my railings installed as they are quite expensive and I am still saving for this. We have however been using the house for a few months without the railings and without incident. The plumber is now threatening to sue me for damages. Can he do this?

Workplace defamation: Can I claim damages?

You are a supervisor managing a number of staff. The business is upon hard times and this stress spills over... into the workplace where staff tempers are short. One day a heated argument between employees arise. When you try and calm them down, the one employee verbally attacks and abuses you, calling you unintelligent and a liar and hurls derogatory slurs at you to embarrass you in front of the other staff. You feel belittled and reluctant to face your staff because you feel your character has been undermined by the employee’s conduct. Can you sue this employee for defamation of your character?
