To post or not to post? When is privacy violated?

Now you’ve taken photos of the mess and want to post them on Facebook to try and get other neighbours to also put pressure on him to clean up the mess. However, you pause and wonder about whether you can post the photos and identify your neighbour. Is it an invasion of privacy, or in the public interest?

No more excuses... we know you got that letter of demand

As always, technology has ensured that there is never a dull moment.With the new and exciting development regarding registered letters... of demand being sent by registered email, consumers can no longer use the excuse that they did not receive their letter of demand.In a ground-breaking judgement, the High Court in Pretoria has very recently accepted the digitally registered delivery of a Section 129 final letter of demand for payment as the basis for granting a default judgment. In the past, consumers received these notices through registered post, with many claiming never to have received it. However this method of correspondence can now be replaced by a letter of demand that's sent and received digitally.As we all know, a letter of demand through registered e-mail or registered SMS is much more difficult to ignore, as it is sent directly to  our cellphone number or e-mail address. This means that it can reach us wherever we are, without us ever having to visit the post office. As the plaintiff argued in this recent case, the digital sending and receipt of a letter demand allows for consumers to get the information that they need to make payment arrangements with the creditor, much quicker - which in turn avoids legal costs and negative credit ratings.In addition, the technology of today allows for an instant electronic certificate and detailed audit report to be issued as evidence that the relevant communication had been sent and delivered by SMS or e-mail – providing exactly the same legal status as traditional registered post.It can even go further to actually show the sender that the recipient actually read the notice. A consumer can therefore not use the excuse anymore that they never received the notice, which will ensure that there are no more unnecessary delays in litigation.

For me speed of sale and registrations is vital. Will this new system improve or worsen the current registration processes?

New developments with precautionary suspensions

I have a suspicion that one of my branch managers is busy stealing stock and cooking the books. The numbers... just don’t add up. I want to suspend him to allow a full investigation to be done, but don’t want to give him a heads-up so he can hide evidence. Can I suspend him immediately without giving him a chance to provide reasons so I can ensure that he leaves the premises? Please advise.

POPI allows you access to your personal information

I run a small franchise electronics store. I collect basic personal information from our customers that we keep on file... and use for marketing notifications to our customers. The other day an upset customer demanded to know what personal information we have of her and said that the POPI Act gave her the right to request a complete copy of her personal information we have. We gave it to her, but I was just wondering whether she really has the right to ask for this?

What print or font is too small for a contract?

I recently bought a second-hand car from a local car dealership. Not long afterwards the car started giving me trouble.... When I took it back to the dealership, they said it was not their responsibility as the contract I had signed transferred all responsibility to me. They showed me the contract, but most of it was printed so small that I couldn’t even read it let alone understand it. Surely I should at least be able to read a contract to be bound by it?

POPI and the quality of your information

These copies are stored in our electronic database. I understand that POPI requires that personal information of clients, such as the quality of copies of identity documents must meet certain requirements. What exactly are these requirements?

Does POPI apply only to electronic records?

I’m an accountant and work from home. I don’t have a computer and have been doing all my work for... years only on paper. My clients have been with me for a long time and I keep physical files for each of them. I’ve taken note of POPI, but I am unsure as to whether it will apply to me, as I don’t have any client information in electronic form. Surely I don’t need to worry about POPI?

POPI and the transfer of personal information outside of South Africa

A strange thing called servitude

I applied to my municipality to have the building plans for the extension of my garage approved. The municipality rejected... my proposed extension on the grounds that it would be constructed over a servitude registered against my title deed in favour of the municipality. What is a servitude? Can I have it removed?
